Scope & Acceptance

These Terms & Conditions (“Terms”) govern your use of BackFlowRates.com (the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.

The Platform is operated by BackFlowRates (“Company,” “we,” “us”). The Platform connects certified backflow testers (“Vendors”) with property owners or managers (“Customers”). Guests may browse the site without creating an account, but Vendors and Customers must register to use certain features.

To use the Platform, you must be at least 18 years old and legally able to enter into binding agreements. By registering, you confirm that you meet these requirements.

Services Provided

BackFlowRates.com operates as an online marketplace that connects property owners and managers with certified backflow testers. We provide a platform for Vendors to list their services and for Customers to discover and contact those Vendors.

We do not perform backflow testing, installation, or repair services ourselves. Vendors are independent contractors, not employees or agents of BackFlowRates. We are not responsible for the quality, safety, or outcome of any services performed by Vendors.

While we make efforts to maintain accurate listings and reliable functionality, we cannot guarantee the availability of Vendors, the accuracy of listings, or uninterrupted access to the Platform.

Subscriptions & Payments

Vendors must maintain an active subscription to post services on the Platform. Subscription options include monthly or annual plans, processed securely through Stripe.

Free Trial: New Vendors may be offered a limited-time free trial. At the end of the trial, a paid subscription is required to continue posting. Only one free trial may be used per Vendor.

Billing & Renewals: Subscriptions automatically renew at the end of each billing period unless canceled. Vendors are responsible for keeping payment information current.

Cancellations & Refunds: Vendors may cancel at any time by emailing Service@BackFlowRates.com. Cancellations take effect at the end of the current billing period. No prorated or partial-month refunds are provided.

Fees & Taxes: Subscription fees are exclusive of applicable taxes. Vendors are responsible for all taxes or fees imposed by law.

Vendor Responsibilities

Vendors are responsible for maintaining accurate and lawful listings on the Platform. By posting services, you represent and warrant that:

• You hold all required licenses, certifications, and approvals to perform backflow testing in your jurisdiction.
• You will comply with all applicable federal, state, and local regulations related to backflow testing and cross-connection control.
• Your listings, service descriptions, and contact details are accurate, truthful, and kept up to date.
• You maintain appropriate insurance and accept full responsibility for the services you provide.
• You will deliver services safely, professionally, and in compliance with industry standards.
• You will not misrepresent your qualifications, pricing, or service coverage.

Vendors acknowledge that BackFlowRates is not responsible for monitoring or verifying licenses, certifications, or compliance with applicable laws. Vendors remain fully liable for their own services.

Customer Responsibilities

Customers are responsible for providing accurate and complete information when using the Platform, including property details, contact information, and backflow device locations.

By using the Platform, you agree that:
• You are at least 18 years old and legally authorized to request services.
• You will not misrepresent property ownership or authorization to order testing.
• You understand that Vendors are independent contractors, not employees or agents of BackFlowRates.
• You accept that BackFlowRates does not guarantee Vendor availability, pricing, or outcomes.
• You will comply with all applicable laws, ordinances, and water provider requirements.

Customers acknowledge that BackFlowRates is a marketplace only and does not perform testing services directly.

Disclaimers & Limitations

The Platform is provided “as is” and “as available.” We make no warranties or representations, express or implied, regarding the accuracy, reliability, or availability of the Platform or any content provided by Vendors.

To the maximum extent permitted by law:
• BackFlowRates disclaims all warranties, including fitness for a particular purpose, merchantability, or non-infringement.
• We are not liable for any damages, losses, or claims arising from Vendor services, Customer actions, or third-party conduct.
• Our liability for any claim related to the Platform will not exceed the total amount paid by you to BackFlowRates in the 12 months prior to the claim.
• We are not responsible for service interruptions, delays, or errors caused by internet outages, third-party providers, or system maintenance.

BackFlowRates does not guarantee that the Platform will be error-free, uninterrupted, or secure at all times.

Termination

We reserve the right to suspend or terminate any account, without notice, if we determine that a Vendor, Customer, or Guest has violated these Terms, engaged in fraudulent or abusive behavior, or otherwise misused the Platform.

Examples of violations include, but are not limited to:
• Posting false, misleading, or illegal content.
• Uploading or posting any content, images, or materials that are offensive, obscene, hateful, discriminatory, or otherwise inappropriate.
• Misrepresenting qualifications, licensing, or certification.
• Attempting to bypass subscription requirements or payment obligations.
• Harassing, threatening, or defrauding other users.
• Unauthorized scraping, data mining, or reverse-engineering of the Platform.

Upon termination, you lose access to the Platform and any associated content or data. Subscription fees are non-refundable. Termination does not relieve you of any obligations incurred prior to termination.

Data & Reporting

Vendors acknowledge that information submitted through the Platform, such as service listings, customer communications, and testing data, may be stored by BackFlowRates for operational purposes.

In the future, BackFlowRates may provide features that allow Vendors to upload or share testing results with property owners, water providers, or regulatory agencies. Any such features will be subject to Vendor consent and applicable law.

BackFlowRates does not verify, validate, or certify the accuracy of any testing data submitted by Vendors. Vendors remain solely responsible for the accuracy and compliance of any reports or documentation they provide.

Amendments

BackFlowRates may update or modify these Terms at any time. When changes are made, we will update the “Effective Date” at the top of this page and, where appropriate, notify registered users by email or site notice.

Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform will be resolved by binding arbitration in Texas, unless otherwise required by applicable law. Users may pursue claims in small claims court if eligible.

You agree that any claim must be brought on an individual basis and not as part of a class action or representative proceeding.

Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, software, and functionality, is the property of BackFlowRates or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform for its intended purposes. No part of the Platform may be copied, modified, distributed, or reverse-engineered without our prior written consent.

Third-Party Services

The Platform may integrate with or link to third-party services such as payment processors (Stripe), automation providers (Zapier), or analytics tools.

BackFlowRates is not responsible for the availability, accuracy, or practices of any third-party services. Your use of third-party services is subject to their own terms and policies.

Force Majeure

BackFlowRates will not be held liable for any delay or failure to perform due to events beyond our reasonable control, including but not limited to natural disasters, acts of God, war, labor disputes, power outages, internet failures, or government actions.
