Scope & Acceptance

These Terms govern your use of BackFlowRates.com, operated by BackFlowRates (“Company,” “we,” “our,” or “us”). The Platform connects certified backflow testers (“Vendors”) with property owners or managers (“Customers”). Guests may browse without an account, but Vendors and Customers must register to access certain features.

By using the Platform, you represent that you are at least 18 years old and legally able to enter binding agreements. If you do not agree to these Terms, you must discontinue use of the Platform.

Nature of the Platform

BackFlowRates.com is an online marketplace. We do not perform backflow testing, installation, repairs, or site inspections. All services are provided by independent Vendors who are not employees, agents, or representatives of BackFlowRates.

We do not control, supervise, or guarantee:

• the quality or safety of any services

• the accuracy of Vendor listings

• Vendor availability

• Vendor pricing, scheduling, or conduct

The Platform is provided as a directory and communication tool only.

Subscriptions & Payments

Vendors must maintain an active subscription to post services. Subscriptions are processed through Stripe.

Free Trial

A one-time free trial may be offered. After expiration, a paid subscription is required to continue posting.

Billing & Renewals

Subscriptions automatically renew unless canceled before the next billing cycle.

Cancellations

Vendors may cancel by emailing service@backflowrates.com . No prorated or partial refunds are offered. Subscriptions remain active through the end of the billing period.

Fees & Taxes

Vendors are responsible for all applicable taxes and government fees.

Vendor Responsibilities

By listing services, Vendors represent and warrant that:

• They hold all licenses, certifications, and approvals required in their jurisdiction

• They comply with all federal, state, and local laws

• Their listings and details are truthful and accurate

• They maintain required insurance

• They provide services professionally and in accordance with industry standards

• They do not misrepresent pricing, service coverage, or qualifications

Important Vendor Acknowledgment

BackFlowRates does not verify, validate, or check:

• licenses

• certifications

• insurance

• local compliance

• device ID accuracy

• test results

• report submissions to water providers

Vendors assume full responsibility for compliance and accuracy.

Customer Responsibilities

Customers agree to:

• Provide accurate property information

• Confirm ownership or legal authorization

• Verify Vendor licensing or approval with their local water provider

• Understand that Vendors are independent contractors

• Accept that BackFlowRates does not guarantee outcomes or service quality

BackFlowRates is not responsible for any service agreement between Customers and Vendors.

Disclaimers & Limitations of Liability

The Platform is provided “as is” and “as available.” We make no warranties regarding:

• accuracy of listings

• availability of Vendors

• quality of Vendor services

• uninterrupted access

• error-free or secure performance

To the fullest extent permitted by law:

• We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement

• We are not liable for damages arising from Vendor actions, Customer actions, third-party conduct, or service outcomes

• Our maximum liability to any user is limited to the total amount paid to BackFlowRates in the 12 months prior to the claim

BackFlowRates is not responsible for delays or errors caused by internet outages or third-party systems.

Termination

We may suspend or terminate accounts without notice for:

• violating these Terms

• posting misleading, illegal, or inappropriate content

• misrepresenting qualifications

• bypassing subscription or payment requirements

• harassment, fraud, or abusive behavior

• scraping or attempting to reverse-engineer the Platform

Termination does not entitle you to a refund.

Data & Reporting

BackFlowRates may store Vendor listings, account information, and communications for operational purposes.

Future features may allow Vendors to upload or share testing results. BackFlowRates does not certify or validate the accuracy of any uploaded data.

Vendors remain fully responsible for:

• reporting accuracy

• regulatory submissions

• compliance

• documentation

Amendments

BackFlowRates may modify these Terms at any time. Updates will be posted with a revised Effective Date. Continued use of the Platform constitutes acceptance of any changes.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas.

Disputes will be resolved through binding arbitration in Texas, unless prohibited by applicable law. Users may seek relief in small claims court where eligible.

Claims must be brought individually, not as class actions or collective proceedings.

Intellectual Property

All content on the Platform is owned by BackFlowRates or licensed to us. Users receive a limited, non-exclusive license to use the Platform for its intended purpose.

No content may be copied, modified, distributed, scraped, or reverse-engineered without written consent.

Third-Party Services

The Platform integrates with external services such as Stripe, Zapier, and analytics tools. BackFlowRates is not responsible for third-party actions, failures, or policies.

Force Majeure

BackFlowRates is not liable for failures caused by events beyond our control, including natural disasters, outages, government orders, or system disruptions.
